General terms and conditions
1. Applicability
In these General Terms and Conditions, the following definitions apply:
'Solid+' brand of VRS+ BVBA, registered under company number 0676.807.206
'Buyer': any natural person (B2C) or (B2B) who is or will be in a contractual relationship of whatever nature with VRS+.
'Products': the subject of one or more purchase agreements.
In addition to these General Terms and Conditions, if expressly indicated, specific terms and conditions may apply to certain services and/or products. If there are differences between these specific terms and conditions and these General Terms and Conditions, the provisions of the specific terms and conditions will in principle prevail over the General Terms and Conditions, unless otherwise stated. It is only possible to deviate from one or more provisions in these General Terms and Conditions on condition of an expressly agreed and written proof. In that case, the other provisions of these terms and conditions will remain in full force and effect. General Terms and Conditions or purchase conditions used by the Buyer do not apply. SOLID+ reserves the right to change and/or supplement the General Terms and Conditions at any time for future orders. By using the website or other electronic portal of SOLID+ and/or placing an order, the Buyer accepts these General Terms and Conditions as well as all other rights and obligations as stated on the Website. SOLID+ can call on third parties when this is required for the correct execution of an agreement with the Buyer.
2. Information and Agreements
VRS+ takes the utmost care when placing information online about the properties of the products, including the technical descriptions based on data from its partners and suppliers, and with photos illustrating the products, all insofar as the technical resources allow and according to the best standards on the market. Certain characteristics of a product, such as color, size, and others, may differ from the photos on delivery, as shown on the website. An agreement is concluded at the moment that an order confirmation has been handed over to the Buyer or, in the event that the offer has been made via the Website, has been sent by e-mail to the e-mail address provided by the Buyer.

A personalized quote is valid for 2 weeks, unless a different term is stated in the quote. VRS+ and its Buyer expressly agree that a valid agreement is concluded by using electronic forms of communication. In particular, the lack of an ordinary, digital or electronic qualified signature does not affect the binding force of the offer and its acceptance. To the extent permitted by law, the electronic files of VRS+ apply as a presumption of evidence. Information, images, verbal announcements, statements, etc. with regard to all offers and the most important characteristics of the products that are provided by telephone or e-mail are (re)displayed or done as accurately as possible.
3. Prices
All prices are expressed in Euro (and in other international currencies such as GBP and USD where applicable) and include VAT and other taxes. Special offers are only valid while stocks last. The Buyer owes the price that VRS+ has communicated to it in its confirmation in accordance with Article 2 of these terms and conditions. Obvious or obvious errors in the quotation, such as obvious inaccuracies, can also be corrected by VRS+ after the agreement has been concluded. Delivery costs are clearly communicated to the Buyer. With regard to certain payment methods, further conditions apply with regard to the delivery method and any costs. This will be clearly communicated to the Buyer.
4. Payment
The sales prices indicated on the site include all taxes, but exclude shipping costs. Any shipping costs are for the Buyer and will be displayed when checking out your digital shopping cart. We reserve the right to change prices at any time, but we undertake to apply the rates indicated on the site at the time of your order. For online orders, payment can be made via the current valid and internationally accepted credit cards and electronic payment methods. Security measures via SSL are planned to ensure that your online payment is safe. If the payment cannot be settled immediately because a financial means of payment is chosen that cannot provide such immediate payment, VRS+ will determine a payment term of 14 days after the invoice date. If the customer does not pay the invoice within this stipulated period, the statutory interests will start to accrue and will be owed without express notice of default. If VRS+ has not received the payment after 3 reminders, the invoice will be transferred to a collection agency that will further handle the procedure. Complaints must be submitted within one week of the invoice date. Filing a complaint does not in any way result in a suspension of payment. All (extra)judicial costs of whatever nature that VRS+ has had to incur as a result of the Buyer's failure to fulfill its (payment) obligations will also be borne by the Buyer.
If a payment method with a credit card (independently or via PayPal) is chosen, the conditions of the relevant card issuer apply. VRS+ is not a party in the relationship between the Buyer and the card issuer.
5. Delivery
We can process your order depending on available stock. In the event that a product ordered by you is not in stock, we undertake to inform you by email within fifteen days of placing the order and to indicate within how long the product can be delivered to you. become.
Orders are delivered as quickly as materially possible. VRS+ does everything within its power to respect the stated delivery times. However, VRS+ takes no responsibility for late delivery or for an order that is lost by third parties or due to unforeseen circumstances or force majeure. If an order is not delivered within the specified time, an investigation will be initiated with the carrier, which may take several days. During this period it is not possible to proceed with a refund or another shipment. Products that are no longer in stock can be ordered. In the event of an order, a delivery period of a maximum of 30 days after ordering must be taken into account. The mere exceeding of a (delivery) term does not put SOLID+ in default. It is important that upon receipt of your products you check whether they conform to your order and if not, notify VRS+ within seven (7) working days. All notifications about a delivery that has not arrived on time must be reported by e-mail to [email protected]. Returned products will only be accepted if they are in their original condition, i.e. in their packaging, accessories and instructions for use included.
Unless otherwise specified, the latest delivery period is thirty (30) days after receipt of the order, with the exception of payment by bank transfer, where the latest delivery period is 30 days after receipt of payment. The stated delivery time is only an indication, insofar as permitted by the Market Practices Act, therefore no rights can be derived from this. Deliveries take place at the address specified by the Buyer during the conclusion of the agreement. As soon as the products to be delivered have been delivered to the specified delivery address, the risk passes to the Buyer.
6. Identity theft and credit card fraud.
To ensure the security of your online transactions, VRS+ works with approved payment partners and credit card issuers. Payments can be made through the following (credit) cards: Visa, MasterCard, Maestro, and others that are clearly and unambiguously mentioned on the website. Online payments are made via a closed security system, which encrypts your bank details at all times when they are sent over the Internet (SSL). Loss or theft of your identity or credit card information is thus kept to a minimum. VRS+ will retain your identity and transaction information in a secure and encrypted database environment over a period of one (1) year. VRS+ believes it has taken all possible and relevant precautions and thus acts as a normal, foresighted and careful online intermediary. Therefore, any identity theft or financial theft cannot be held against VRS+.
7. Defects and submission of complaints
The Buyer is always obliged to carefully examine the products immediately upon receipt.
Complaints from Buyer relating to defects in the product or delivery, which are externally visible, must be notified in writing to VRS+ by Buyer within seven (7) days of delivery (or within seven (7) days of the invoice date if the products were not (or could not be) delivered to Buyer). We recommend that you send your order by registered mail and take out insurance with the carrier, for the market value of the products. This is in case of theft or loss of the products with the carrier. For all returns, the costs are for the Buyer.
The Buyer is not entitled to return the products for which there are no justified complaints. If the above is not followed up and goods are returned wrongly, all costs associated with returning the goods shall be borne by Buyer. In that case, VRS+ shall be free to store the products with third parties at the Buyer's expense and risk, and/or, at the Buyer's implicit or explicit request and expense, return these items to the Buyer.
8. Exchange
The Market Practices Act (WMPC) stipulates that the Buyer may return the product within a period of 14 calendar days without any consequence in terms of penalties or giving reasons. This is called the right of renunciation. Products that are custom designed (goods that are manufactured according to the specifications of the consumer or that have a clear personal character) fall outside the application of this right pursuant to Article 47, §4, 2° WMPC. In this case, one can think of various articles of clothing (helmets, gloves, shoes, etc.), accessories and related goods that are made to measure or on request. Such products are therefore not eligible for return.
Likewise, audio and video recordings and computer software products whose seals have been broken by the consumer (e.g. audiovisual works related to motor activities), and newspapers, magazines and periodicals are not eligible for return.
A return must be sent by Post or another carrier. Returning an order is at the User's expense and risk, except if the product is non-conforming. Within the warranty extension period, the customer must return the product to SOLID+ and request a return document at [email protected].
Upon valid and legally correct use of the above-mentioned right of renunciation, VRS+ will, within seven (7) working days, ensure reimbursement of the sum paid by the Buyer to VRS+, through a method of payment chosen by it but generally accepted internationally.
No refund shall be possible if the right of renunciation was unlawfully used. In that case, the goods shall be returned to the Buyer, at the Buyer's own expense and risk, subject to substantiated notification.
9. Warranty
As imposed by the applicable and relevant statutory provisions, a statutory warranty shall apply to the products delivered by VRS+. If the delivered item does not comply with the agreement, Buyer must inform VRS+ of this no later than within seven (7) working days following delivery. Any resulting compensation can never exceed the amount as invoiced to Buyer. Usual or normal wear and tear, unintentional or deliberate changes made by the Buyer to the product, failure to present an original invoice or valid proof of payment and various omissions are express, but not exhaustive, exceptions to the aforementioned warranty.
URLs that are included on the website or other electronic communication portals, which are under the actual control of VRS+, are to be clicked and visited by the Buyer at its own responsibility.
10. Force majeure
In the event of force majeure, VRS+ shall not be bound to fulfil its obligations to the other party. VRS+ shall be entitled to suspend its obligations for the duration of the force majeure.
Force majeure shall mean any circumstance beyond its control as a result of which fulfilment of its obligations to the other party is prevented in whole or in part.
11. Intellectual property
All intellectual property rights and derived rights shall be retained by VRS+ . These intellectual property rights mean copyright, trademark, drawing and model rights and/or other (intellectual property) rights, including patentable or non-patentable technical and/or commercial know-how, methods and concepts. The Buyer is prohibited from using and/or making changes to the intellectual property rights as described in this Article, unless it is purely for private use of the product itself.
12. Processing personal data
The information provided by you is necessary for the processing and completion of orders, and the preparation of invoices and guarantee contracts. If this information is missing, the order will inevitably be cancelled. The provision of incorrect or false personal data, is considered a violation of the present General Terms and Conditions. The Buyer's personal data will only be processed in accordance with the applicable privacy statement, consultable via the VRS+ website.
13. Applicable law and competent court
Belgian law applies exclusively to all offers and agreements. The applicability of the Vienna Sales Convention is expressly excluded. All disputes related to or arising from offers from VRS+, or agreements entered into with it, shall be submitted to the competent territorial court, unless a mandatory statutory provision explicitly designates another court as competent.
